These Terms of Service (“Terms”) govern your access to and use of our website, mobile experiences, and AI-powered food safety tools (collectively, the “Service”). By accessing or using the Service, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, do not use GlutenScan.

1. Purpose of the Service

GlutenScan provides automated, AI-generated analyses of restaurant menus and ingredient lists to help users identify potential gluten-containing ingredients, cross-contamination risks, and labeling inconsistencies. The Service is intended for general informational and educational purposes only. It is not medical advice and is not a substitute for professional dietary consultation or restaurant verification.

2. Critical Health & Safety Disclaimer

GlutenScan does not guarantee the safety, accuracy, or completeness of any analysis. Our AI interprets text extracted from menus provided by users or public sources, which may be incomplete, inaccurate, outdated, or misleading. Restaurant ingredients, recipes, suppliers, and preparation methods can change without notice, and cross-contact with gluten may occur in shared kitchens.

You are solely responsible for your dietary choices and health outcomes. Always confirm ingredients, preparation methods, and cross-contamination procedures directly with restaurant staff before consuming any food or beverage. If you have celiac disease, a gluten allergy, or any other medical condition, consult your physician or a qualified dietitian before relying on information derived from GlutenScan.

By using the Service, you expressly acknowledge and agree that GlutenScan and its affiliates are not liable for any illness, allergic reaction, injury, or adverse health consequence arising from your interpretation or use of information provided by the Service.

3. Eligibility & Accounts

To use certain features, you may create an account or authenticate via Google or email. You must be at least 16 years old (or the age of majority in your jurisdiction). You are responsible for safeguarding your credentials and for all activities under your account. Notify us promptly of any unauthorized use or suspected breach.

4. Acceptable Use

You agree not to use the Service to:

• Submit, upload, or share content that is unlawful, defamatory, misleading, or infringes third-party rights;
• Interfere with or disrupt the Service or the servers and networks connected to it;
• Reverse-engineer, scrape, or access the Service using automated means without our written permission;
• Collect, process, or store personal data of others without lawful basis and consent.

5. Service Availability, Changes & Usage Limits

We may modify, suspend, or discontinue any aspect of the Service at any time without notice. We may change pricing and introduce usage limits (e.g., a set number of free scans) or subscription tiers. We make no guarantee that the Service will be uninterrupted, error-free, or compatible with your device.

6. Data & Privacy

Our collection and processing of personal data are described in our Privacy Policy. By using the Service, you consent to processing of menus, URLs, images, and other materials you submit, for providing and improving the Service.

You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and analyze such content to operate, maintain, and improve the Service, including for AI model training in de-identified or aggregated form where permitted by law.

7. Intellectual Property

The Service (including software, features, design, text, graphics, and models) is protected by intellectual property rights owned by us or our licensors. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

8. AI Content Disclaimer

The Service relies on probabilistic AI models. Outputs may be incomplete, inaccurate, biased, or contextually inappropriate. We do not warrant the correctness, reliability, or suitability of any AI-generated content. You agree not to rely solely on AI outputs for health or safety decisions.

9. No Warranties

THE SERVICE AND ALL INFORMATION PROVIDED BY GLUTENSCAN ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLUTENSCAN, ITS FOUNDERS, EMPLOYEES, PARTNERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION ANY LOSS OF DATA, PROFITS, GOODWILL, OR HEALTH-RELATED INJURIES, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR RELIANCE ON ANY INFORMATION PROVIDED. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID (IF ANY) FOR ACCESS TO THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless GlutenScan and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your reliance on information obtained through the Service.

12. Suspension & Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, misused the Service, or engaged in conduct harmful to users or our reputation. Upon termination, your right to use the Service will cease immediately.

13. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will reflect the effective date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of France, without regard to conflict-of-law rules. The courts of Paris, France shall have exclusive jurisdiction.
